VA Declines Certifying a Veteran’s Hemp Because of Marijuana’s Federal Status

Last week, the Department of Veterans Affairs rejected an application made by a veteran requesting that his hemp product firm be recognized. In its denial letter, the department stated that the department could not endorse the business because it was involved in products derived from the same genus of the marijuana plant, which would give the impression that a federal agency was endorsing the plant. This rejection highlights the confusion around hemp’s legal status, which is defined as cannabis sativa L., and its derivatives, which contain less than 0.3% THC under U.S. law. Marijuana products with higher THC concentrations are still classified as Schedule I substances and remain illegal under the Controlled Substances Act. The company in question, Holistic Serendipity LLC, operates under a native ceuticals licensing agreement. The company, which is owned by Zack Zindler, was seeking certification as a veteran-owned, service-disabled small business.

More Than Half of Missouri Voters Support Adult-Use Cannabis Legalization

A recent poll has revealed that more than half of Missouri voters support adult-use cannabis legalization as activists work to place an adult-use measure on the state’s 2022 ballot. The poll, conducted by SurveyUSA, surveyed 1,782 registered voters between May 11 and May 15, according to a Riverfront Times report, and asked: “Should the use of marijuana for recreational use remain against the law in Missouri? Or be legalized?” Sixty-two percent of respondents said adult-use cannabis should be legalized, the news outlet reported; 71% of those in favor are ages 18 to 49, while 59% are ages 50 to 64. Only 46% of respondents over the age of 65 said they support legalization, according to the Riverfront Times, but only 35% of that demographic said that adult-use cannabis should remain illegal; 18% answered that they were undecided.

Cannabis home delivery slated to begin in Connecticut

Home delivery to Connecticut cannabis consumers is one step closer to reality as the lottery for delivery licenses closed last week. “Delivery service is one of the license types now available in Connecticut as part of the new adult-use program,” Kaitlyn Krasselt, communications director at the Connecticut Department of Consumer Protection, told The Center Square. “Home delivery will also be available to patients in the medical marijuana program.” Medical dispensary facilities are allowed to deliver if the entity submits an application to the department and satisfies an inspection. A bill passed last year allows those who receive these licenses to deliver their product to homes on the first day that the Department of Consumer Protection allows recreational sales. The infrastructure for home delivery is already in place. “Connecticut already has 22 medical cannabis dispensaries, all of which will likely convert to adult use and start delivery operations when the adult-use market opens,” DeVaughn Ward, senior legislative council at Marijuana Policy Project, told The Center Square. “Additionally, consumers already receive controlled products like alcohol and pharmaceuticals through delivery in Connecticut.”

Innovative Industrial Properties, Inc. (“IIPR” as listed on the NYSE) is a real estate investment trust (“REIT”) focused on the acquisition, ownership and management of specialized industrial properties leased to experienced, state-licensed operators for their regulated state-licensed cannabis facilities. Commenced on April 25, 2022, the IIPR class action lawsuit – captioned Mallozzi v. Hemp, CBD legalization unanimously approved in North Carolina Senate. Next stop, the House.

Hemp and CBD could become illegal in North Carolina by the end of June as the state’s temporary legalization comes to an end. Now, the state Senate has approved the bill that would keep it legal. On Tuesday, the North Carolina Senate unanimously voted to pass Senate Bill 762. The bill still needs approval in the House and the governor’s signature before becoming law. The bill would allow farmers to continue to grow hemp as a foundation for the fiber found in rope and garments and other products but also for the CBD products, such as oils, vapes and other consumables. The difference is that these products are very low in intoxicants, such as THC, and serve more to soothe people than to make them high. Since Hemp farming became legal under federal law in 2014, there are about 1,500 hemp growers and more than 1,200 processors in North Carolina registered under the USDA Domestic Hemp Production Rule.

The dispute largely focuses on an audio recording that surfaced late last week, which appears to depict a top staffer for Democratic House leadership and other party operatives seemingly conspiring to influence the outcome of the November elections by giving voters what would look like a Trump-affiliated party to support on the ballot as an alternative to the traditional Republican ticket. It would have also have the purported benefit for Democrats of taking off of the ballot one of two official cannabis-named parties that some believe have siphoned votes from the Democratic-Farmer-Labor (DFL) Party in past elections.
