Pennsylvania court rules medical cannabis still a controlled substance
Judge Deborah A. Kunselman rejected an appeal from a Pennsylvania medical cannabis patient who was convicted of DUI. A court in Pennsylvania this month ruled against a medical cannabis patient who had appealed a 2021 driving under the influence conviction. The York Daily Record has the background on the case involving Franklin Dabney, a 29-year-old from Hanover, Pennsylvania who was arrested in 2020 after a Pennsylvania state trooper in an unmarked vehicle clocked him going 93 miles per hour in a 65 zone. The trooper “noticed a ‘strong odor of raw marijuana coming from inside the vehicle,” the York Daily Record reported, prompting Dabney to “[take] out a medical marijuana card and [state] that the smell was probably originating from his clothes.” “Law enforcement conducted a warrantless search of the vehicle, finding flakes of suspected marijuana near the center console and front-passenger seat as well as a shopping bag containing three baggies of weed,” the Daily Record reported. “Dabney, police said, had dilated and red eyes. He also showed signs of impairment during standard field sobriety tests. Police arrested Dabney and took him to Gettysburg Hospital, where a blood test revealed that he had active marijuana compounds and metabolites in his system. Prosecutors later agreed to exclude the weed found in his car from evidence and withdrew three of the charges against him.”

London Mayor announces plan to study cannabis legalization
London Mayor Sadiq Khan announced plans to study cannabis legalization during a visit to a dispensary and cultivation facility in Los Angeles. London Mayor Sadiq Khan announced a plan to study the legalization of cannabis on Wednesday after visiting a dispensary and cultivation facility as part of an official visit to Los Angeles. Khan said that he was forming a commission to study cannabis legalization and named a prominent Labour Party official to head the panel. Khan walked among growing cannabis plants and was introduced to the wide variety of products available at licensed cannabis dispensaries. The London mayor said that the commission he was appointing would examine the effectiveness of the city’s drug laws and explore how legalizing pot could help reduce “drug-related harm.” “The illegal drugs trade causes huge damage to our society and we need to do more to tackle this epidemic and further the debate around our drugs laws,” Khan said. “That’s why I am in LA to see first-hand the approach they have taken to cannabis.” The commission will gather evidence on cannabis legalization from around the world and will study the public health benefits of cannabis, the best methods to prevent misuse and effective law enforcement strategies. The panel will make recommendations to City Hall and government officials, law enforcement, and public health officials. More appointments to the commission will be announced this summer. The London Drugs Commission is not expected to make its first report until next year.

Trinidad & Tobago: Court Of Appeal Requested To Clarify Cannabis Possession Issue
Newsday Trinidad & Tobago report THE Court of Appeal will be asked to clarify what appears to be a lacuna in the Dangerous Drugs (Amendment) Act on the possession of fewer than 30 grammes of marijuana. At a hearing of magisterial appeals on Thursday, deputy DPP Tricia Hudlin-Cooper told Justices of Appeal Alice Yorke-Soo Hon and Gregory Smith the State will be asking the court to clarify the law. She said there appeared to be a lacuna between “Parliament’s intent and what pertains now.” “It has been causing trouble in the lower courts,” Hudlin-Cooper admitted. She said the legislation allows someone found in simple possession of less than 30 grammes of marijuana to apply for a conviction to be expunged. However, she hinted there was a loophole in terms of where the alleged offence occurred. In two of three appeals, the judges ordered submissions to be filed in June and have adjourned the matters to July 20. Those cases involved the arrest of a prison officer and a university student. In the matter of Cpl Leroy Baptiste against prison officer Max Durity, the State appealed after he was found not guilty in the Arima Magistrates Court in October 2014.

Detroit’s new recreational cannabis ordinance challenged in lawsuit
Via The Detroit News A chain of medical marijuana dispensaries filed a lawsuit in Wayne County Circuit Court Wednesday challenging Detroit’s new recreational marijuana ordinance. A provision in the ordinance, which was approved last month by the Detroit City Council, doesn’t allow medical marijuana establishments to be eligible to obtain a recreational license for five years. The lawsuit brought by four House of Dank dispensaries — each operating under a unique name — said that wording violates the state’s 2018 recreational marijuana law. The ordinance, which went into effect April 20, reads: “Commencing on January 1, 2027, any licensees which are holders of one or more licenses to operate a medical marijuana provisioning center in accordance with this article and which have been the holder of such licenses since prior to the effective date of this ordinance, may apply for an adult-use retailer license.” The city’s law department said it had not had a chance to review the complaint and declined to comment Wednesday. House of Dank, which opened a medical dispensary on Eight Mile in 2015, now has four medical dispensaries in Detroit and four recreational dispensaries elsewhere in Michigan. “

California Cannabis Firms Sell Assets, Narrow Focus
When the recreational marijuana industry was launched in California, the trend was for every company to be vertically integrated. This meant that everything was handled in-house from cultivation and manufacturing to packing, retail sales and distribution. As the industry has matured, the shortcomings of vertical integration have become all too apparent, and companies are divesting themselves of many divisions and operations in order to focus on their key competencies. NorCal Cannabis is one example of a marijuana company that has taken the route of shedding excess weight from its operations. In the beginning, NorCal went the vertical integration route, operating everything from cultivation facilities to retail locations and even a huge home-delivery operation. However, the company noticed that it was bleeding money on each delivery run its vehicles made, so the logical thing for NorCal to do was to divest itself of marijuana delivery, so the company let its delivery license expire. NorCal CEO Jigar Patel says that things have been looking up ever since the executive team made the hard decision to concentrate on cultivation as well as building the company brand.

Bipartisan Senators Push To Finally Enact Marijuana Banking Legislation
Nearly a quarter of the members of the U.S. Senate are joining together to call on congressional leaders to ensure that marijuana banking provisions are enacted into law as part of a large-scale manufacturing bill. The 24 senators—including 19 Democrats and five Republicans—wrote in a letter that the Secure and Fair Enforcement (SAFE) Banking Act would “help cannabis-related businesses, support innovation, create jobs, and strengthen public safety in our communities.” The lawmakers, led by Sens. Jeff Merkley (D-OR) and Jacky Rosen (D-NV), want the marijuana provisions included in the America COMPETES Act, which a bicameral conference committee will discuss at its first meeting on Thursday. Noting that cannabis banking legislation has passed the House six times at this point, including as a standalone bill “garnering the support of more than three-quarters of the chamber and a majority of the members of each party,” the bipartisan group of senators said that finally getting the reform enacted into law has “demonstrated broad support.” “The cannabis industry has become a powerful job creator and a significant generator of tax revenue,” they wrote.
