ACLU Suing Nevada Over Cannabis Constitution Issue
State law — and the will of Nevada voters — is clear that cannabis is legal to possess and use for medicinal and recreational purposes. Yet state agencies, including the Nevada State Board of Pharmacy, continue to list it as a Schedule I substance alongside meth, heroin, and cocaine. Instead of treating cannabis like alcohol and removing it from the state’s list of controlled substances, Nevada is ignoring its state Constitution and the will of the people. The American Civil Liberties Union of Nevada Foundation on Friday filed a writ with the intent of finally ending the practice. The case, CEIC v. Nevada Board of Pharmacy, was filed in Clark County court. For cannabis to be classified as a Schedule I substance, the Board of Pharmacy must find that it has no accepted medical use in the treatment or it cannot be safely distributed to the public. However, the Nevada Constitution explicitly allows for the “use by a patient, upon the advice of his physician, of a plant of the genus Cannabis for the treatment or alleviation of cancer, glaucoma, acquired immunodeficiency syndrome… or other chronic or debilitating medical conditions”.

Three In Four South Carolina GOP Voters Support Medical Marijuana As House Floor Debate Approaches, Poll Finds
Three in four South Carolina Republican primary voters say they support legalizing medical marijuana, according to a new poll. The survey from Benchmark Research asked GOP voters in the state whether they favor “allowing patients who suffer from an approved list of conditions to have access to medical marijuana if approved by their doctor.” And as a Senate-passed medical cannabis bill heads to the House floor, the poll found that 76 percent of people who are registered to vote in the Republican primary election on June 14 back the reform. That’s compared to just 17 percent who oppose the policy change and eight percent who are unsure. The poll, which was first reported by FITSNews, also showed majority GOP support for medical marijuana legalization in seven major areas of the state, ranging from 67 percent in Augusta and Columbia to 91 percent in Savannah. The survey involved interviews with 350 South Carolina Republican primary voters from April 8-11 and has a margin of error of +/- 4.9 percentage points.

Nevada Police Are Exploiting Marijuana Scheduling ‘Loophole’ To Make Arrests Despite Legalization, ACLU-Backed Lawsuit Claims
A new lawsuit is backed by the Nevada chapter of the ACLU claims that the state’s drug code unconstitutionally continues to list marijuana as a Schedule I drug, enabling police to continue to arrest people over cannabis despite the fact that it’s been legalized for medical and adult use. The suit targets the state Board of Pharmacy, which has scheduling authority over controlled substances. Plaintiffs say that because the board has failed to remove marijuana from Schedule I, people continue to run the risk of being prosecuted for felony crimes such as possession of cannabis with intent to distribute. Police have allegedly exploited that legal “loophole” even though the state Constitution recognizes the medical value of marijuana and voters approved adult-use legalization on the ballot in 2016. Marijuana Legalization Tied To ‘Significant Reductions’ In Prescription Drug Use, Researchers Find
Legalizing marijuana for adult use is associated with decreased use of prescription drugs for the treatment of conditions such as anxiety, sleep, pain, and seizures, according to a new research paper. Several previous studies have identified associations with the enactment of medical cannabis legalization at the state level and reduced pharmaceutical prescriptions, but this latest paper published in the journal Health Economics focuses on the potential impact of recreational legalization in 10 states plus Washington, D.C. Researchers used data from Medicaid reporting on prescription drugs from 2011 to 2019, using two-way fixed effects event study models to determine whether there’s a statistically significant relationship between giving adults legal access to regulated marijuana and the use of pharmaceuticals for six different conditions. The study found that there are “significant reductions in the volume of prescriptions within the drug classes that align with the medical indications for pain, depression, anxiety, sleep, psychosis, and seizures” in states that legalized cannabis for adult use.

Marijuana Trafficking Is Changing At US-Mexico Border
While the DEA did not outright attribute recreational marijuana legalization to the decrease in trafficked weed over the U.S. border, there is certainly a connection to be made. The United States and Mexico border has made front-page news daily for nearly a decade for all sorts of reasons. Whether it is building an expansive border wall, major immigration policy issues — or even the ever-evolving problems of drug smuggling — there is always something critical to report on this 1,954-mile-long imaginary line. Recently, however, there has been a shakeup in one of the U.S. and Mexican border’s previously-biggest talking points: marijuana trafficking. Only a decade ago, Mexico was smuggling a significant amount of the marijuana consumed by Americans, according to the DEA. Now it appears as though marijuana smuggling into the United States is decreasing, while Mexico is seeing an increase of American-made pot entering its side of the border. The DEA released a new report, stating that, “in U.S. markets, Mexican marijuana has largely been supplanted by domestic-produced marijuana.” This is a major shift from the days when the vast majority of marijuana was coming into the United States from Mexico.=
