House Passes Bipartisan Marijuana Research Bill To Let Scientists Study Dispensary Products, Days After Legalization Vote
The U.S. House of Representatives on Monday approved a bipartisan marijuana research bill that’s meant to streamline studies into cannabis, in part by allowing scientists to access products from state-legal dispensaries. This comes days after the chamber separately approved a bill to federally legalize marijuana for the second time in history. And it also follows the Senate’s unanimous approval of a similar cannabis research bill last month. The Medical Marijuana Research Act, sponsored by the unlikely duo of pro-legalization Rep. Earl Blumenauer (D-OR) and prohibitionist Rep. Andy Harris (R-MD), passed the House in a 343-75 vote. “The cannabis laws in this country are broken, including those that deal with the medical research of marijuana,” Blumenauer said in a press release. “America’s growing cannabis industry operates without the benefit of a robust research program. Instead, we are outsourcing research to Israel, the United Kingdom, and Canada to our detriment.” “One example of this policy failure is our inability to effectively test for cannabis impairment. Employees are failing drug tests, not because they are impaired, but because they used recreational or medical cannabis sometime in the last month,” he said.

South Carolina Lawmakers Hear Senate-Passed Medical Marijuana Legalization Bill In Committee
A South Carolina House committee on Monday discussed a Senate-passed bill to legalize medical marijuana in the state, with members hearing hours of testimony from a wide range of voices including military veterans and pharmacists. The House Medical, Military, Public, and Municipal Affairs Committee took up the legislation from Sen. Tom Davis (R) one week after a subcommittee voted unanimously to advance it. The Compassionate Care Act passed the full Senate in February. It was profiled in late 2020 and passed out of the Senate Medical Affairs Committee last March, but alone senator blocked it from reaching the chamber floor in 2021. Since then, Davis has redoubled his efforts to get the bill across the finish line, arguing that South Carolina voters are ready for what he’s repeatedly called “the most conservative medical cannabis bill in the country.” Davis used his testimony to address House colleagues’ concerns that had been raised earlier in the hearing, including worries about the possibility of increased impaired driving post-legalization. “I keep hearing that if we authorize medical cannabis, there’s going to be an increase in impaired driving.

Illinois Marijuana Sales Rebound In March, Reaching $131 Million, State Officials Report
Illinois’s marijuana market seems to be rebounding after a couple of months of lagging sales, with officials reporting on Monday that the state saw nearly $131 million in legal recreational cannabis purchases last month. That’s the second-highest recorded sales month for adult-use marijuana since the industry opened in 2020. The Illinois Department of Financial and Professional Regulation (IDFPR) reported that there were almost $90.4 million in adult-use cannabis sales from in-state consumers last month, while about $40.6 million came from out-of-state visitors. A total of 3,007,699 individual marijuana items were sold in March. The totals don’t include medical cannabis products, which are reported separately by a different state agency. While Illinois broke its yearly record for cannabis sales in 2021—with more than $1.4 billion in cannabis sold last year—marijuana purchases dipped in January and February, following the December 2021 record-high of $137,896,859. From last year’s sales, Illinois generated almost $100 million more in tax revenue from adult-use marijuana sales than from alcohol in 2021, state data found. It’s unclear what factors may have contributed to the dip at the beginning of this year, or the rebound in March.

CBD Is Expensive: How The Industry Can Re-Think Its Pricing For Consumers
The last two years haven’t been great for the CBD industry. The pandemic cratered in-store sales of CBD. Meanwhile, by choosing not to regulate CBD, the FDA left it in a legal gray area, limiting where it can be sold. If you need evidence of the industry’s decline, just look at Charlotte’s Web, the largest CBD company. In mid-2019, the company’s stock price was flying high at nearly $22. Since then, it’s fallen to just over $1 — a 95% decline. I believe there’s a way out of this mess, but most companies aren’t prepared, or willing, to see it. Let’s revisit the history of the industry to see why. In 2014, the federal farm bill passed, and the hemp industry was reborn. Positive feedback from consumers helped CBD quickly become a craze. It was a product that could help a lot of people and offer an effective, natural alternative to pharmaceutical drugs for a variety of conditions. Investors jumped in—betting on large industry growth—and the largest companies quickly went public (which creates the expectation of more growth). These companies ran the traditional CPG playbook, adding CBD to dog treats, seltzer and everything else under the sun. They focused on selling more to the consumer, not adding value. Thanks to declining sales, large companies are burning cash and goodwill with their investors. They’re banking on a federal bailout: that the FDA will formally regulate CBD, thereby allowing them to peddle their premium products into larger retail channels.

Entity structure considerations for MSOs
Multi-state operators may need to weave a complex web when it comes to corporate structure. Operators entering new jurisdictions must consider many factors, the most significant being tax exposure, licensing restrictions, and potential exit scenarios as they determine which entity structures will best support their expansion and goals. The goal of structuring is to create an efficient model that benefits investors, is attractive to acquirers, and helps maximize gains and control taxes. In most established (fully legalized) industries, the choice is often straightforward. Many start-ups will default to a limited liability company (LLC) that is treated as a partnership and reduces tax liability. In cannabis, however, industry-specific factors, such as restrictions on deductions (Internal Revenue Code 280E) and the likelihood of stock transactions in the event of a sale, make the entity choice less straightforward. Look at tax exposure One of the more straightforward considerations in entity structure when entering a new jurisdiction is the impact on owner/investor income taxes and cash flow. When initially structuring the entity, owners must determine when they anticipate receiving dividends.

Workers at St. Louis medical marijuana dispensary vote to form a union
Workers at a St. Louis medical marijuana dispensary have voted to unionize, becoming the first cannabis workers in Missouri to do so, a local chapter of the United Food and Commercial Workers announced on Monday. All eight workers in the bargaining unit at the Root 66 dispensary on South Grand voted in favor of the UFCW representing them in contract negotiations with management, a news release from the union said. “Cannabis workers across the country are voting to join a union because they know it’s the best way to secure good wages and benefits on the job,” said David Cook, president of Local 655 of the UFCW. “Workers need economic security and fair treatment in the workplace, and cannabis workers are no different,” he said. “We are committed to helping cannabis workers across Missouri.” Joseph Delia, chief operating officer of Root 66, did not immediately respond to a request for comment on Monday. The official name of the company is GF Wellness. Local 655 said workers voiced concerns about wages, paid sick leave, and vacation time during the unionization campaign.
