By Jelena Martinovic Healthcare technology company Veriheal announced findings from its annual Medical Cannabis Preference Report, a segmented survey of registered medical cannabis patients that illuminates which types of cannabis products are preferred by men and women and what product offerings patients most hope to see available in dispensaries. “Veriheal seeks to give the patient community a voice, while also boosting research that helps cannabis companies make better, more tailored products and connect patients with the medicine they need,” said Anthony Dutcher, Veriheal CMO. The company drew data from 125,000 patient signups registered in 2021, surveying cannabis use preferences, user experience, medical conditions and several other variables which factor into their cannabis use. The findings include a strong preference by men for cannabis flowers over edibles, while women are more neutral. Moreover, roughly 30% of patients surveyed would prefer to see more edibles on the market, compared to an average of 21.5% of respondents who said they wished more flowers were available.

New York State agencies haven’t touched millions sitting in medical marijuana funds

New York State agencies haven’t touched millions sitting in medical marijuana funds. An NYCI investigation has found that two New York State agencies are sitting on millions of dollars collected from medical marijuana taxes, but neither has spent the money — despite a mandate that the funds be used for public health and safety initiatives. As of Feb. 28, the Office of Addiction Services and Supports and Division of Criminal Justice Services have $1.6 million and $1.4 million (respectively) sitting in the funds. That money has accumulated since 2014, when the state mandated that a portion of medical marijuana revenue is set aside for the agencies to use toward addiction support and criminal justice services. “Why aren’t they drawing down this money, and why is it sitting there?” said State Senator Diane Savino, who sponsored New York’s medical marijuana bill. “It’s not like there isn’t a need,” she said. The senator also said she wasn’t aware the funds sat untouched until NYCI contacted her. “Just spend it — allocate it and send it out the door,” Savino said, adding that she would send a formal letter to each agency asking for an explanation. The language within state law is unambiguous: It says the Division of Criminal Justice Services “shall” use the money “for a program of discretionary grants to state and local law enforcement agencies that demonstrate a need.

California Might Legalize Interstate Cannabis Sales

A few weeks ago, California lawmakers quietly introduced SB-1326, a bill that would amend the Medicinal and Adult-Use Cannabis Regulation and Safety Act (MAUCRSA) to legalize interstate cannabis sales, notwithstanding the status of federal law. Specifically, SB-1326 would authorize the Governor to enter into an agreement with other states authorizing medicinal or adult-use commercial cannabis activity, or both, between entities licensed under the laws of the other states and California entities operating with a state license. If enacted in its current version, the bill would also: Limit interstate commercial cannabis activities to out-of-state operators that secure a state license, or a local license, permit, or other authorization issued by the local jurisdiction. Require that the other states impose requirements, including product safety, labeling, and testing requirements, on their cannabis licensees that meet or exceed the requirements applicable to MAUCRSA licensees. Mandate that the agreement includes provisions for the collection of applicable taxes. Among these three additional provisions, the second may be the most interesting. Imposing burdensome requirements on out-of-state cannabis licensees could run afoul of the Dormant Commerce Clause (DCC).

Ten years ago, Emmet Reistroffer was standing in front of the Minnehaha County Administration building petitioning for medical cannabis. Now, as COO of Genesis Farms LLC, Reistroffer is celebrating the beginning stages of bringing Minnehaha County its first medical marijuana dispensary. Following a months-long debate on safely regulating medical marijuana use since becoming legal last July, Minnehaha County Commission finally authorized its first-ever license to dispense medical cannabis. On Tuesday, the four-member board unanimously approved the single-capped license for Genesis Farms during a public hearing at its weekly meeting. Commissioner Jean Bender was absent from the meeting. More: Minnehaha County gets 4 applications for the first and only marijuana dispensary The location of Genesis Farms dispensary will be at 7605 E Arrowhead Parkway. County auditor Ben Kyte informed commissioners Genesis Farms had cleared all the hurdles, from getting their conditional use permit approved through the Planning and Zoning Commission and other approvals through the state. By default, via their lottery system process, Genesis Farms was chosen for final approval and other applications were not considered. “We’re working with neighbors to make sure it’s a compatible location,” said Reistroffer.

State Treasurers Discuss Marijuana Banking Challenges At Annual Conference With Congressional Officials

State treasures from across the U.S. participated in a panel on Tuesday that focused on federal marijuana banking reform as part of a three-day conference organized by the National Association of State Treasurers (NAST) that was attended by stakeholders and congressional officials. Moderated by Colorado Treasurer Dave Young, the panel discussed the “history, challenges, and prospects for SAFE banking laws that would allow legal cannabis businesses into the mainstream banking system,” according to an event description. The Secure and Fair Enforcement (SAFE) Banking Act was a focal point of the discussion. That bill, sponsored by Rep. Ed Perlmutter (D-CO), would protect financial institutions that choose to service state-legal cannabis businesses from being penalized by federal regulators. It’s passed the U.S. House of Representatives in some form six times but has yet to advance in the Senate under either Republican or Democratic control. Perlmutter’s senior legislative assistant Colin Anonsen spoke on the NAST conference panel, alongside representatives of Scotts Miracle-Gro and the American Bankers Association (ABA). ABA recently released a poll it commissioned showing majority support for marijuana banking reform among Americans.
