A top Justice Department official remarked that the department’s decision to investigating marijuana industry mergers due to the attorney general’s bias against legalization was, in fact, put in place to protect consumers’ “access” to the marijuana industry. Many officials to both the justice department and the attorney are arguing the investigations consistent with protecting consumers’ access to cannabis products. Makan Delrahim, assistant attorney general for the Antitrust Division points to the lack of subject matter expertise as a reason for the investigation and argues that the investigation could lead to effective antitrust enforcement for lower prices and higher output, quality, and innovation.
