New York senator Michelle Hinchey filed legislation called “Cannabis Container Bill of Rights,” which pushes for recycling across the cannabis industry once retail sales officially begin, reported Marijuana Moment. The measure asks marijuana shops to provide a $1 deposit for any cannabis product sold in single-use plastic containers and to reimburse customers when they return the container. The proposed legislation would also demand that all cannabis products use packaging made from 50% recycled materials, at a minimum. Last year, Hinchey sponsored another measure that would give priority to hemp-based packaging over synthetic plastics for cannabis products. The bill’s justification segment notes that New York’s recreational cannabis law has important packaging demands like childproof sealing, which have caused the industry to have an enormous plastics footprint. “The legal cannabis industry in the United States produces about 150 million tons of waste each year. Even when marijuana packaging is recycled at home, it is often sorted out by recyclers and taken to landfills,” it says. “While no industry is blameless in the plastic pollution crisis, New York has a unique opportunity to prevent a new source of plastic pollution as we consider the legalization of recreational marijuana.” This bill is the same as one filed by Assemblymember Patricia Fahy (D) last year, but this new Senate version had been presented to the Senate Environmental Conservation Committee.

Pennsylvania Lawmakers Host First Cannabis Legalization Hearing
Despite Pennsylvania lawmakers and the governor proposing adult-use cannabis legalization for years, Monday was the first time a committee took up legalization in the General Assembly. The Senate Law & Justice Committee held a hearing on Monday that included lawmakers and members of law enforcement to testify on legalization. It was the first of three such hearings, and subsequent ones will focus on, for example, regulation and lessons learned from other states. The conversation largely focused on concerns, ranging from increasing crime and substance use to changes to how members of law enforcement currently do their jobs. Another repeated topic of discussion was just how sophisticated the state’s unlicensed cannabis market has become. Pennsylvania lawmakers have for years introduced legislation to legalize cannabis. Those bills, though, stalled before gaining any traction, due primarily to a lack of support from Republicans in the legislature, as Cannabis Wire has extensively reported. Sen. Daniel Laughlin, who has co-sponsored adult use legislation in the past, said on Monday that the medical cannabis program without adult-use cannabis was the “worst of both worlds.”

Louisiana patients loving newly legal cannabis flower
On January 1, 2022, cannabis flower finally became available to Louisiana’s 10,000 registered medical marijuana patients. Patients and pharmacists are pleased with the newfound access. Now they’re hoping supply will increase to meet demand—and bring down those high prices. Louisiana became the first Deep South state to legalize medical cannabis in limited forms back in 2016, but those forms were extremely limited. The smokeable flower was not allowed. Now the Bayou State is allowing patients to find relief with the plant directly. Governor John Bel Edwards set the change into motion last summer by signing House Bill 391, which legalized the dispensing, purchasing, and usage of medical cannabis in flower form. This is a big step forward, as cannabis flower represents roughly half of all product sales in most medical and adult-use states. In order to receive a medical marijuana card, patients have to send their medical records to a Medical Cannabis Physician (who has to be licensed and in good standing) to determine their debilitating condition(s), schedule a consultation appointment (via telehealth or in-person), and receive a medical recommendation from their physician. Consultation appointments cost around $200 and are not covered by health insurance due to the continuing federal prohibition of cannabis in all forms. We interviewed a few medical marijuana professionals and patients to get their insight, thoughts, and sentiments regarding the legalization and dispensing of medical flowers.

Cannabis REIT Chicago Atlantic Lends $34 Million to Ohio Operator FARMACEUTICALRX
PHARMACEUTICALRX, one of the largest producers of premium organic medical marijuana products in the US market, today announced that it has closed a $34 million senior secured term loan (the “Senior Term Loan”) provided by Chicago Atlantic Real Estate Finance, Inc. Should Connecticut change mold and yeast levels in medical cannabis?
As the state considers whether to adjust the required mold and yeast levels in medical cannabis products, patients and others remain concerned about the proposed change and are calling for stricter testing standards. The public comment period ended last week on the state Department of Consumer Protection’s proposed changes, which would set the total limit at 100,000 colony forming units per gram and wouldn’t allow any detectable levels of harmful breeds of mold in the Aspergillus family. The change would mean increasing the levels for one lab, while the other facility would need to lower its amount after gaining state approval last year for more mold and yeast in its products. The proposal came in December after patients complained about the state approving a request from AltaSci Labs last year to raise its limits from 10,000 units per gram to 1 million. The approval occurred via email, and patients weren’t notified of the change. State officials and AltaSci’s lab director have said the Aspergillus requirement makes the products safer. The other lab, Northeast Laboratories, left its limit at 10,000 units per gram. Some of Connecticut’s 54,000 medical marijuana patients have expressed concerns over transparency and the safety of the products after learning the state approved the change for AltaSci Labs.

New CO Legislation Is Making Doctors Stand Back From Recommending Cannabis To Patients
A new Colorado law aimed at keeping young people from buying and reselling highly potent THC concentrate has sparked concerns from doctors who recommend medical cannabis about how the new provisions could jeopardize their ability to practice medicine. The law, which has some doctors saying they have stopped working with medical cannabis patients altogether, requires that patients obtain written “certifications” from doctors in order to access marijuana concentrates over a new daily limit. Doctors must include new information on those forms like a patient’s address, maximum THC potency level, dosage, directions for use, and a daily authorized quantity. Previously in Colorado, doctors would recommend cannabis rather than prescribe it, in keeping with a 9th U.S. Circuit Court of Appeals ruling that protects a doctor’s right to “recommend” and discuss the health benefits of cannabis as part of a doctor-patient relationship. But the new requirements for concentrates in House Bill 1317, which was approved by the legislature last year, are more akin to writing a prescription for cannabis, which remains illegal under federal law, said Dr. Laura Lasater. Doctors must maintain an active certification with the Drug Enforcement Agency to practice medicine.
