A Medical Cannabis Market Emerges: Mississippi Prepares for Business License Applications This Summer
After Mississippi Gov. Tate Reeves signed a bill to legalize medical cannabis in the state in February, agencies like the Department of Health and the Department of Revenue began writing regulations for the marketplace that will materialize later this year. Not every rule is set in stone just yet, but already prospective business owners have a sense of what’s needed to get in on the action. License applications may be submitted to the DOH in early June (for cultivation, processing, testing, research, disposal and transportation operations) and to the DOR in early July (for dispensary operations). Those dates are coming soon: But industry observers caution against haste. There will be time aplenty to submit paperwork. The important thing is what’s contained within that paperwork. Clare Millette, partner at Cosmich Simmons & Brown PLLC, says that it’s vital to think through the full business plan—long-term. “[Applicants] need to know there’s so much information, and there are so many different ways that you can participate in this industry,” she says. “You need to have a clear vision for where you see yourself entering this industry.”

MariMed Completes Two Acquisitions in Maryland and Illinois
Multistate operator MariMed recently locked down two new acquisitions: Kind Therapeutics, in Maryland, and Green Growth, in Illinois. Multistate operator MariMed recently locked down two new acquisitions: Kind Therapeutics, in Maryland, and Green Growth, in Illinois. The company, which already had a footprint in Maryland through other licensed business acquisitions, had been eyeing Kind Therapeutics for the past few years. MariMed owned Kind’s cultivation and production facility in Hagerstown, as well as a 6,000-sq.-ft. building in Anne Arundel County that was being developed as a Kind Therapeutics dispensary location. Kind had been leasing those facilities from MariMed. The intention now is to expand those Kind operations and layer them into MariMed’s existing Maryland infrastructure. For instance, at the cultivation site, MariMed plans to add another 40,000 square feet of canopy, as well as a GMP kitchen for cannabis edibles. Some 630 miles to the west, the newly closed Green Growth acquisition will allow MariMed to vertically integrate its cannabis operations in Illinois. Green Growth held cultivation, manufacturing and distribution licenses; MariMed had only claimed a retail license in that state until this point.

Australia’s Little Green Pharma Inks UK Medical Cannabis Deal
Little Green Pharma Ltd announced on Monday it had entered into a medicinal cannabis distribution agreement with Sana Life Sciences. Under the Agreement, the parties grant each other mutual exclusivity across the UK and Crown Dependencies for the supply or distribution of LGP 10:10 Classic Oil and other oils with the same or similar ratios. But this is subject to Sana meeting certain minimum exclusivity purchase thresholds per annum. LGP says the agreement represents an annual revenue opportunity of A$1.44m post-ramp up for just the exclusive oil product. The agreement also covers a non-exclusive supply of LGP’s Classic Oils and Desert Flame flower medicines, along with an LGP-branded flower product that is currently in development. “… the Agreement represents a key step in LGP’s twin strategy of selling its own LGP-branded sales into the UK and EU while developing and supplying client-specific white-label strains for clients across Europe,” stated the company. In other recent news from Little Green Pharma, the firm recently released its activities report for the quarter ending March 31, 2022 indicating unaudited revenue of $3.2 million and cash receipts of $3.0 million.

GOP Congressman Requests Hearing On FDA’s Failure To Set CBD And Delta-8 THC Regulations
The top Republican on a key congressional committee is calling on leadership to schedule a hearing to hold the Food and Drug Administration (FDA) accountable for its lack of action to set regulations for CBD and delta-8 THC products. Rep. James Comer (R-KY), ranking member of the House Oversight and Reform Committee, said in a letter to Chairwoman Carolyn Maloney (D-NY) that the purpose of the meeting should be to “examine the failure of [FDA] to develop a regulatory regime that effectively oversees the sale of hemp-derived extracts such as cannabidiol (CBD).” He said that the current lack of regulations has led to mislabeling, contaminated products, and advertising that targets children. “We must hear directly from the FDA to ensure the agency has a plan to institute a regulatory solution that can effectively monitor the sale of hemp products and protect the health of children,” he wrote. The federal legalization of hemp under the 2018 Farm Bill was a bipartisan effort, and members across the aisle have since been pushing for further reforms to create a regulatory framework for products that are derived from the crop. FDA is cognizant of the complaints, but it’s so far declined to enact rules providing for the marketing of legal cannabinoids in food products.

Delaware Lawmakers Approve Marijuana Legalization Bill In Committee Again Following Procedural Misstep
A Delaware House committee on Tuesday approved a bill to legalize marijuana for a second time following a procedural mishap that inadvertently prevented public testimony on the proposal at an earlier meeting. Rep. Ed Osienski (D) is sponsoring the legislation to simply legalize cannabis possession and gifting, as well as a companion bill that would create a regulatory framework for the market. The two-track approach to reform is the sponsor’s response to the House defeating a prior measure in March that included both components. The idea is to get the basic legalization bill through the chamber with a simple majority, thereby putting pressure on lawmakers to support the separate proposal that requires a 3/5th supermajority, rather than leave the market unregulated. Key legislators have signaled that the bifurcated approach might work, even if they don’t support legalization. But because of a procedural issue last month—with the chair of the House Health & Human Services Committee approving a motion to vote on the simple legalization bill HB 371 before the public had a chance to testify—the timeline was pushed back.

South Carolina Medical Marijuana Bill Dies On House Floor Following Procedural Challenge
A bill to legalize medical marijuana in South Carolina died on the House floor on Wednesday following a nuanced debate over the constitutionality of the legislative process that the measure has moved through—before any discussion of the merits of the bill itself could occur. Advocates had already expected pushback on the Senate-passed legislation sponsored by Sen. Tom Davis (R), with opponents filing more than 1,000 amendments ahead of its floor consideration. But things became even more complicated after a constitutional challenge from Rep. John McCravy (R), who raised a point of order against the Senate bill, claiming that because it involves a tax on medical cannabis, it should have originated in the House under the state constitution’s provisions for legislation that raises revenue. House Speaker Pro Tem Thomas Pope (R) mulled the issue over during a lunch break and later ruled to sustain the point of order. Rep. Todd Rutherford (D) then sought to appeal the ruling, saying he planned an amendment to scrap the tax language later, but there was a subsequent motion to table his appeal, which was agreed upon by the body in a 59-55 vote, effectively killing the measure.
